SMS Marketing Consent Policy

Effective date: [Insert date of publication] Last updated: 2026-08-23

This policy explains how Outering Tours and Safaris Ltd (Company Number PVT-DLUL56M8), trading as "Stolink" ("we", "us") sends promotional SMS messages, and (once launched) WhatsApp messages, to Customers and Contacts, in accordance with the Kenya Information and Communications Act (Cap 411A), the Consumer Protection Act, 2012, and the Data Protection Act, 2019. It should be read together with the Privacy Policy.

1. Scope

This policy covers promotional/marketing messages only — offers, new-model announcements, campaign content sent through our campaign management system. It does not cover account security notices or authentication, which never use SMS (per the Terms of Service §4, sign-in is by email/password or Google only — SMS is never used as an OTP channel).

Current channel: SMS, delivered via Africa's Talking. WhatsApp campaigns are not yet active — they are planned for a future release using the Meta WhatsApp Business Platform, and this policy will be updated with WhatsApp-specific consent and opt-out mechanics (including template approval and the 24-hour session-messaging window) before that channel launches.

2. Who receives these messages, and on what basis

  • Registered Customers: at signup, you are asked to opt in to promotional messaging via a clear, unticked checkbox — separate from account creation, which does not require it. You may opt in or out at any time from your account settings.
  • Legacy and referral Contacts: as explained in the Privacy Policy §4, Kaisa Traders' pre-existing customer records were imported into the Platform so past customers can be re-engaged. We rely on the existing customer relationship as a legitimate interest basis to send a limited volume of relevant offers to these numbers, always with a clear opt-out on every message, in line with the Data Protection Act, 2019. If you did not expect to receive a message from us, you can opt out immediately (§4) and request more information about why you were contacted (see Privacy Policy §8).

3. What you can expect

  • Message frequency: campaigns are sent as one-off, manually scheduled sends — there is currently no recurring/automated messaging.
  • Content: promotional offers, new device announcements, and similar campaign content targeted using your purchase history, device interest, or payment type.
  • Standard network SMS rates from your mobile carrier may apply to receiving messages, though we do not charge you directly to send them.

4. Opting out

You can opt out of promotional SMS at any time by:

  • replying STOP to any promotional message; or
  • disabling promotional messages in your account settings (registered Customers); or
  • contacting us at stolinkapp@gmail.com and asking to be removed (Contacts without an account).

We will honour an opt-out request as soon as reasonably possible and no later than before the next scheduled campaign. Opting out of promotional messages does not affect account or order-related notices, which are not marketing communications.

5. Data used for targeting

Campaign targeting uses purchase history, device model, and payment type (cash vs. financed) already described in the Privacy Policy. We do not share your phone number or profile with third parties for their own marketing purposes — Africa's Talking (and, in future, Meta) act solely as our message delivery providers under the Privacy Policy §5.

6. Changes to this policy

We may update this policy — in particular, when WhatsApp campaigns launch. Material changes will be notified via the Platform.

7. Contact

Questions or complaints about promotional messaging: stolinkapp@gmail.com

You may also lodge a complaint with the Communications Authority of Kenya or the Office of the Data Protection Commissioner if you believe we have not honoured an opt-out request.
